The Supreme Court (STF) formed a majority on Thursday (26) and ruled in favor of the thesis that could lead to the annulment of some sentences of Operation Lava Jato and affect one of the convictions of former President Lula.
Favorable to the thesis were ministers Alexandre de Moraes, Rosa Weber, Carmen Lúcia, Ricardo Lewandowski, Gilmar Mendes and Celso de Mello.
Contrary to this thesis, the rapporteur minister Edson Fachin and the ministers Luis Roberto Barroso and Luiz Fux voted.
The Supreme Judge appeals the former Petrobras manager, Márcio de Almeida, convicted in the Lava Jato. Defendant defense attorneys maintain that, in the final stage of the process, accused defendants must speak last, after the whistleblowers.
The votes of Minister Marco Aurélio Mello and Minister Dias Toffoli remain. The latter, chairman of the Supreme Court, decided to adjourn the session on Thursday (26) and ordered the resumption of discussion at the session on Wednesday (2).
Toffoli said that next week he will propose a modulation of understanding, that is, a restricted application of the thesis to certain cases or whether it will fit all cases where there has been conviction.
Former President Luiz Inacio Lula da Silva has called for the annulment of two convictions, referring to the case of the Guarujá triplex for which he is imprisoned and the Atibaia site, in which case Lula has already been convicted at first instance.
