The Federal District Court on Wednesday acquitted former presidents Luiz Inacio Lula da Silva and Dilma Rousseff, as well as Antonio Palocci and Guido Mantega and João Vaccari Neto, in the process dubbed the "PT's quadrillion".
Judge Marcus Vinicius Reis Bastos, from the 12th Federal Court in Brasilia, said that the complaint filed against PT members "reflects an attempt to criminalize political activity".
The criminal case involving former presidents Luiz Inacio Lula da Silva and Dilma Rousseff, former ministers Antonio Palocci and Guido Mantega, and former PT treasurer João Vaccari Neto, pointed to a suspected criminal organization crime.
According to the judge's decision, "the description of the facts seen in the complaint does not contain the constitutive elements of the offense provided for in Article 2 of Law No. 12,850 / 2013 (criminal organization)".
"The narrative it concludes does not allow the conclusion, even in theory, of the existence of an association of four or more people structurally ordered, with division of tasks, some form of hierarchy and stability," said the judge.
"The accusation filed, in fact, translates into an attempt to criminalize political activity. It adopts a certain assumption – that of the installation of a 'criminal organization' that lasted until the end of the term of former President Dilma Vana Rousseff – presenting it as being ' truth of the facts, "not even bothering to point out the essentials of characterizing the crime of criminal organization," he added.
